These General Terms and Conditions (“Terms”) govern the relationship between Diversity Concepts (“we,” “our,” or “Diversity Concepts”) and users of our platform, including employers posting jobs and candidates applying for positions.

1. Scope and Applicability

1.1 These Terms apply to all services and interactions on the Diversity Concepts platform. By using our platform, users (“you”) agree to be bound by these Terms.

1.2 The most recent version of these Terms will apply. We may update them from time to time. You will be notified of changes, and continued use of the platform implies acceptance.

1.3 Conflicting terms from users or external entities will not apply unless agreed in writing.

1.4 If any part of these Terms is found invalid, the rest remain enforceable.

 

2. Platform Use and Responsibilities

2.1 Diversity Concepts provides a platform where employers can post job listings and candidates can apply. We are not a recruitment agency and do not guarantee job placement or candidate selection.

2.2 All users must provide truthful and lawful information. Misuse of the platform, including fraudulent job postings or inaccurate applications, may lead to suspension.

 

3. Intellectual Property and Concept Protection

3.1 If Diversity Concepts develops a proposal, concept, or solution for your review (such as job description templates or hiring frameworks), it remains our intellectual property unless otherwise agreed.

3.2 You may not reuse, replicate, or adapt our creative concepts without written permission. If you believe similar ideas were developed independently, notify us within 14 days with proof.

4. Artificial Intelligence (AI) Content

4.1 Our platform may use AI to help generate job descriptions, review resumes, or recommend matches.

4.2 All AI content is supplemental. Users are responsible for verifying its accuracy and suitability.

4.3 AI-generated material will be clearly marked. If you wish to opt out of AI features, contact Support@dicpts.com. Some services may be limited as a result.

4.4 We are not liable for errors or decisions made based on AI-generated suggestions.

 

5. Service Details and User Obligations

5.1 Our services are described on the platform. Specific agreements (like paid job posts or employer services) may come with separate terms.

5.2 Users must provide accurate, up-to-date information and ensure that uploaded content (such as logos, resumes, and documents) does not infringe third-party rights.

5.3 Users are responsible for ensuring their content complies with employment laws, copyright laws, and privacy regulations.

6. Third-Party Services

6.1 We may use or recommend third-party tools or services (e.g., resume scanning, email delivery). We are not liable for those services but will select reputable providers.

6.2 Some services may require direct agreements with these third parties.

 

7. Timelines and Changes

7.1 Deadlines for optional premium services (like featured job listings) are estimates. Delays may occur due to external factors.

7.2 If services are delayed due to your inaction or incorrect information, we are not responsible for associated delays.

 

8. Termination and Suspension

8.1 Either party may terminate use of the platform. We may suspend or terminate your access for violations of these Terms or abuse of the platform.

8.2 In cases of serious breaches (e.g., fake job listings, abusive behavior), we may act without prior notice.

 

9. Fees and Payments

9.1 Basic platform use is free. Premium services (like sponsored listings) are priced as shown at checkout.

9.2 Payments are due immediately unless otherwise stated. All prices are shown excluding taxes unless stated.

9.3 Refunds may be issued at our discretion, particularly if services were not used or if we fail to deliver due to our error.

 

10. Ownership and Usage Rights

10.1 You retain rights to your user-generated content (resumes, listings). We retain rights to our platform features and designs.

10.2 You may not copy, alter, or distribute our platform’s underlying tools or proprietary methods.

11. Brand and Attribution

11.1 Diversity Concepts may display your company’s name and logo as part of case studies or portfolio, unless you opt out in writing.

 

12. Warranties and Disclaimers

12.1 We strive to maintain platform reliability but do not guarantee uninterrupted access or outcomes from job listings or applications.

12.2 You agree to use the platform at your own risk. We are not responsible for third-party behavior, including candidate or employer actions.

 

13. Liability Limits

13.1 Our liability is limited to the amount paid for the service in question.

13.2 We are not liable for indirect or consequential damages, including missed hiring opportunities or employment disputes.

 

14. Data Privacy and Consent

14.1 By using our platform, you consent to our data handling practices, which may include collecting contact details, job history, and preferences to deliver services.

14.2 Users may unsubscribe from promotional emails at any time.

 

15. Legal Jurisdiction

15.1 These Terms are governed by the laws of the United States. Any disputes will be handled by courts located in the state where Diversity Concepts operates.

 

16. Final Provisions

16.1 Headings are for convenience only and do not affect interpretation.

16.2 If any clause is found unenforceable, the rest of the Terms remain valid.

16.3 These Terms represent the full agreement between Diversity Concepts and the user regarding the use of the platform.
